Likely story. I think you were personally attacking me, and I feel personally attacked, from your attack on my person, which I take personally.

 

Yeah, the posts have been all about auto although our office does much more than just that. Each state is different, but typically depending on what part of the vehicles touched, you could be not at fault. It helps that your daughter wasn't cited by the police. Normally, however, the one who is moving switching lanes tends to be at fault, at least in my experience.

Just like in my instance, I was backing out of my parking space and being well over 50% of the way out (at the point of turning my wheel to turn out of the space) my coworker (who is also an agent and as been for 13+ years) decided to continue speeding and moving into the opposite lane of traffic instead of stopping and I hit the side of her van. She stopped, got out and looked at the damage on her car and said 'I'm not filing a claim' AND LEAVES. I barely got a photo of her car before she takes off. Stupid of me, I didn't take a photo of the way my car was positioned at the time, only a pic of the back of my car to show I only had paint marks on my tire (spare tire sits on the trunk hood thing of my car).
She comes back a few days later and said, 'oh i want to file a claim now'. My insurance carrier told me had I taken a picture of the way my car was positioned, I wouldn't have been held liable. But no police were called and I didn't have that picture. So lesson learned: regardless of who you get in an accident with, call the police and take lots of pictures.

yea the insurance determines she was at fault. We have accident forgiveness (according to geico) but I am pretty sure we already used it..also I feel bad for this kid when she leaves in May (she is moving in with her best friend). Her insurance will probably be higher than a 300000 house payment, sigh.
