I didn't know they could straight up break during regular use, maybe it's time to move up a level

 

When I'm just sitting and waiting for something to pop I'll kind of just mindlessly do reps on a light weight one like a 1 or a 1.5, so the spring probably gets worked too much. The one I broke was a 1.5.

The sound was certainly surprising, I just about tipped over my chair.

That's hard. If there's been any modifications at all to the original source that the thing was pirated from, then it's a crap shoot whether or not they own it. They definitely own the intellectual property, but do they own the derivative work from it?

Let's say someone takes Pokemon Ruby and ports it to a ROM, but makes the clock functionality slightly different. Nintendo (and the Pokemon Company, and whatever other stakeholders are involved with it) own the original work, Pokemon Ruby, and they own the right to own and enforce that intellectual property which would prevent others from copyrighting or making money from it over them. That does not mean that they would own the modification that the cracker added to it -- they could just enforce an order to prevent the cracker from profiting from his/her work.

Legally dubious, but definitely arguable (probably, IANAL).

Any modification made to the original can be used by Nintendo for profit without compensating the person who made the modification. Bethesda has done it with mods even when those mods were made under Bethesda's EULA. It's not really stealing, unless there is a third party app attached. You can't violate the law and then claim ownership unless it's abandonware or opensourced. Plus, the main thing these guys do is build the emulator. THey don't really modify the games that much. Either way, Nintendo probably didn't take anything from anyone. Even the guy that Nintendo was accused of taking work from said they probably didn't since the way the games were cracked was the only way to do it.
