California Supreme Court increased the regulations for obtaining criminal and full background checks on applicants for employment and housing. This made the procedure more cumbersome, and there are significant penalties if we mess it up and don't disclose properly. They felt background checking was being used to exclude people from housing and employment who had paid their debts but weren't being allowed back into society. There is also another round of legislature going up right now for approval that would limit what we can and cannot check (currently, we TOTALLY cannot use the Meghan's Law database to screen out sex offenders, so we kinda just have to rent to them, we're not allowed to check at all).

The Lawyers for the California Apartment Association did a seminar and said that with the way things are going, and the risk of being sued, unless there is a clearly defined need to screen on criminal history, we should avoid doing so. I'd have to find my notes from that seminar to know exactly what part of their ruling implied that, but somethings something somethings legal mumbo jumbo gave precedent for being sued.

We do still check for evictions, and in that checking often see a laundry list of criminal convictions, but we're not allowed to use that in our decision making. If we do, we have to give out many disclosures of why we used those convictions and be ready to defend our policies for using them. And we have to be 100% consistent on what we exclude on which seems super easy in theory, but life is not linear or black and white and that's so easy to mess up or overlook one offense on accident for one person and not on another.

So, we just avoid them now on advice of legal counsel.

Just easier to have a minimum credit score and hope that screens out people who have been in prison for a long time.
